Race Face Photos (“we”, “us”) runs racefacephotos.com, a marketplace where independent photographers (“photographers”) sell digital photos they took at races to athletes and other buyers (“buyers”). By using the site you agree to these terms.
1. The marketplace
Photographers own and sell their photos; we provide the website, bib detection, checkout and delivery. When you buy a photo, you buy it from the photographer who took it. Payments are processed by Stripe. We collect payment on the photographer's behalf and pay the photographer their share through Stripe Connect.
2. Buying photos
- All products are digital downloads. Prices are set by the photographer and shown in US dollars before you pay.
- A single-photo purchase covers that photo. A bundle covers every photo the photographer has tagged with your bib number at that event, including photos tagged after you buy.
- Your download link is sent to the email address you give at checkout and works for 90 days after payment. You can request a new link from the site during that time.
- Bib detection is automatic and can be wrong. Check the preview before you buy; see our refund policy if something is not right.
3. Personal-use licence
Unless the photographer agrees otherwise in writing, a purchase gives you a non-exclusive, perpetual licence to use the photo for personal, non-commercial purposes, including printing it and sharing it on social media. The photographer keeps the copyright. You may not resell the photo or use it in advertising without the photographer's permission.
4. Photographers
- You must own the photos you upload and have the right to sell them, and you must follow the rules of the event and the laws where you shoot.
- You must complete Stripe's onboarding to receive payouts. You receive 90% of each sale, less a proportional share of Stripe's card processing fee; we keep the remainder as our platform fee.
- You grant us a licence to store your photos, create watermarked previews and display them to promote and sell them on the site.
- You are responsible for any taxes on your sales.
5. Removing photos
If you appear in a photo and want it taken down, email contact@racefacephotos.com with the link. We will hide it from public view promptly. Copyright complaints go to the same address.
6. Acceptable use
Do not upload unlawful content, try to download photos without paying, scrape the site, or interfere with its operation. We may suspend accounts that do.
7. Disclaimers and liability
The site is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid for the order concerned.
8. Changes
We may update these terms; the date above shows the latest version. Continuing to use the site after a change means you accept it.
